Lower court decision stands, allowing a high school to continue the practice.
The Supreme Court refused to take up a case that would have restricted a Virginia high school from considering race in its admissions process, leaving the previous decision of a lower court in place that rejected the claim.
Thomas Jefferson High School for Science and Technology is an elite Virginia school that historically accepted an Asian American majority. In 2020, the local school board revised the high school’s admissions policy, keeping the grade requirements in place but prioritizing the acceptance of black, Hispanic, and other minority students.
Parents and students brought the suit against the school, claiming discrimination against Asian Americans. The 4th Circuit Court of Appeals found that the diversity policy does not cause measurable harm to the Asian American community. Since the Supreme Court declined to take on the case, the appellate court’s ruling stands.
